Legal Basis of the Church’s Governmental Authority in Ancient Russia of the 11th – 13th Centuries

The purpose of the study is to identify the range of rights and duties the government of the Russian Church was given in the period from the 11th to the first third of the 13th century.
Problem. Researchers have insufficiently used the monuments of canon law as they are presented in the Kormchaya Book, the main law of the Church, which did not allow creating a holistic view of the legal foundations of church authority in Russia.
Methodology. The research is based on the method of structural and functional analysis, allowing to consider the specifics of the rights and duties of the main institutions of government of the Church and to reveal their interaction. The sources were legislative materials, including the Kormchaya Book of the Old Slavic edition and the church charter of Prince Vladimir. The materials for the analysis are extracted from the publications of V.N. Beneshevich and Ya.N. Shchapov.
Novelty. The data on the oldest lists of the Kormchaya Book are introduced into scientific circulation in the context of the history of the Church as a social institution for the first time (it is proved that the oldest list is the Efremovskaya Kormchaya). The novelty of the research is also seen in the disclosure of the mechanisms of interaction between the branches and institutions of government of the Church, as well as in the author's development of a typology of the norms of the Church Charter of Prince Vladimir.
Results. The author substantiates the necessity of studying the law enforcement practice of the Church. An overview of the general contents of the Kormchaya Book is performed. The results of a comparative analysis of canons and laws are presented. Definitions of canonical, liturgical, and general discipline are given. It is shown that the text of the charter of Prince Vladimir has evolved in the course of its existence. The author concludes that it is impossible to adequately assess the scope of the powers of the church authorities in Ancient Russia not taking into account the ratio of editions and recensions of canonical monuments.
Discussion. The research perspectives are to analyze the monuments of ancient Russian literature, primarily chronicles and the lives of saints, which will allow to study the law enforcement practice of the government of the Church and find out how relevant the rules developed in Byzantium were for Russia.
